Terms of Use

Welcome to Play With ASL. These Terms of Use ("Terms") are a legal agreement between you and Play With ASL, LLC ("Play With ASL," "we," "us," or "our"), a limited liability company organized under the laws of the State of Delaware. They govern your use of the Play With ASL mobile application on iOS and Android, our website at https://www.playwithasl.com, and any related features we offer (together, the "Services").

Please read these Terms carefully. They include important information about your subscription, your right to cancel, the limits of our liability, and how disputes are resolved.

1. Acceptance of Terms

By creating an account, downloading the app, or otherwise using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated herein by reference. If you do not agree, please do not use the Services.

  • These Terms apply to every user of the Services, including users of the free portions of the app.

  • If you are using the Services on behalf of a child (see Section 2), you agree to these Terms on the child's behalf as well as your own.

  • If you downloaded the app from the Apple App Store, the Apple Standard End User License Agreement at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ also applies on iOS. If anything in these Terms conflicts with the Apple Standard EULA on iOS, the Apple Standard EULA controls for that conflict only.

  • If you downloaded the app from Google Play, Google's Play Terms of Service apply to your use of Google Play and your payment relationship with Google.

  • Geographic scope. The Services are operated from the United States and are intended for users in the United States. They are not intended for use in any jurisdiction where doing so would conflict with local law (including the arbitration agreement in Section 15 or the age threshold in Section 2). If you choose to access the Services from outside the United States, you do so on your own initiative and are responsible for compliance with local law. Local consumer-protection rules — including the General Data Protection Regulation ("GDPR") in the European Economic Area and the United Kingdom — may override specific provisions of these Terms to the extent required by applicable law.

2. Eligibility and Children

Play With ASL is rated 4+ on the App Store and is designed to be family-friendly. We do not show third-party advertising, we do not allow user-generated content, and we do not track users across other apps or websites.

  • You must be at least 13 years old to create your own account. In jurisdictions where applicable law sets a higher minimum age for digital-services consent — including the European Economic Area and the United Kingdom, where Article 8 of the GDPR generally sets the age at 16 — the local minimum age applies. If you are under the applicable minimum age, a parent or legal guardian must create the account, agree to these Terms on your behalf, and supervise the child's use of the Services.

  • Parental consent (COPPA). For users under 13 in the United States, a parent or legal guardian must provide verifiable consent before the child uses any feature that requires an account, in line with the Children's Online Privacy Protection Act ("COPPA"). By creating an account for a child under 13, you confirm that you are that child's parent or legal guardian and that you consent to our collection and use of the limited information described in our Privacy Policy.

  • If we learn that we have collected personal information from a child without the required parental consent, we will delete that information promptly. To report a concern, contact us at jon@playwithasl.com.

3. Account Registration

To unlock the full app, save progress across devices, and restore purchases, you create an account using Firebase Authentication with your email address and a password.

  • You agree to provide accurate information, to keep your password confidential, and to let us know promptly at jon@playwithasl.com if you suspect your account has been used without your permission.

  • One person, one account. You may not share your account credentials or sell access to your account.

  • We do not require phone-number verification, captcha, or email verification before you start using the app. We may add those steps in the future for security reasons.

  • An optional profile photo feature can request access to your device camera or photo library. We only use those permissions if you choose to add a photo, and we describe the data we collect in our Privacy Policy.

You can delete your account from inside the app at any time. Open the app and follow this path: Main Menu → Play → Sign In → Game Modes → Memory Match or TILT! → gear icon (top-left) → Account Management → Delete Account → type DELETE to confirm. When you complete that flow, we permanently delete your account and the personal data associated with it, subject to the limited retention described in the Privacy Policy (for example, records we are required to keep for tax, fraud-prevention, or legal reasons). You can also exercise your privacy choices, including data deletion, at https://www.playwithasl.com/privacy-policy/delete-data.

Deleting your account does not automatically cancel an active subscription billed through Apple or Google. See Section 4 for cancellation steps.

4. Subscriptions — Auto-Renewal, Billing, and Cancellation

Play With ASL offers two auto-renewable subscriptions that unlock the full vocabulary catalog and additional benefits:

  • Monthly subscription (product ID pwa_month_sub) — billed once per month.

  • Annual subscription (product ID pwa_yearly_sub) — billed once per year.

Both plans include:

  • Access to the full Memory Match and TILT! vocabulary catalog while the subscription is active.

  • The ability to select two card packs per billing period that you keep permanently, even if you later cancel.

  • A 20% subscriber discount on individual card pack purchases (see Section 5).

4.1 Auto-renewal disclosure

Consistent with the disclosure shown beneath the in-app paywall:

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Payment is charged to your Apple ID account or Google Play account (depending on the store you purchased from) at the confirmation of purchase and again at the start of each new billing period.

  • The renewal price is the price shown on the paywall at the time you purchase, unless the store notifies you of a price change in advance, in which case you have the right to refuse the new price and cancel.

  • The subscription term and any introductory offer are shown on the paywall before you confirm. We do not store payment card details — Apple and Google handle billing.

  • Pricing may differ by region or currency, as determined by Apple or Google.

4.2 How to cancel — iOS (App Store)

On an iPhone or iPad, open Settings → [your name] → Subscriptions, tap Play With ASL, then tap Cancel Subscription. Apple's instructions are at https://support.apple.com/en-us/HT202039.

4.3 How to cancel — Android (Google Play)

Open the Google Play Store app, tap your profile icon → Payments & subscriptions → Subscriptions, tap Play With ASL, then tap Cancel subscription. Google's instructions are at https://support.google.com/googleplay/answer/7018481.

If you cancel before the end of the current paid period, you keep access until that period ends and you will not be charged again. Uninstalling the app does not cancel a subscription — you must cancel through the store.

4.4 Refunds

Refunds for subscriptions and in-app purchases are handled by the store you bought from, and are subject to that store's then-current refund policy:

We can help you locate the right form, but we cannot override Apple's or Google's refund decisions. Nothing in this Section limits any non-waivable refund or cancellation right you have under applicable consumer-protection law (see Section 13).

5. In-App Purchases — Card Packs

Outside of subscriptions, you can buy individual card packs.

  • Single card pack (product ID pwa_single_card_pack) — a one-time, consumable purchase under the store's billing model. Each purchase entitles you to permanently unlock one card pack of your choice. The product is "consumable" only in the technical sense that you can buy it again to unlock additional packs.

  • Restoring purchases. Unlocked packs are tied to your Firebase account, so if you sign in on a new device, you can restore them with the in-app Restore Purchases button. Restoration requires signing in with the same account you used at purchase.

  • Subscriber discount. Subscribers receive 20% off individual card pack purchases while their subscription is active. If your subscription lapses, future purchases revert to the full price; previously unlocked packs remain unlocked.

5.1 Legacy purchase — grandfather clause

A number of customers purchased a legacy non-consumable product called memory_match_category_pack_1 under our v1.x app. This product is no longer offered in v2.x.

  • We honor those purchases as a grandfather right. If you bought memory_match_category_pack_1 under v1.x, the content you originally received remains accessible to you, subject to these Terms.

  • Legacy purchasers are not entitled to the v2.x subscription catalog or the subscriber discount unless they separately subscribe.

  • If you cannot restore access to a legacy purchase, please contact jon@playwithasl.com.

6. License and Permitted Use

Subject to your compliance with these Terms, we grant you a personal, non-commercial, non-transferable, non-exclusive, revocable license to install and use the Play With ASL app on devices you own or control, and to use the Services for your own learning.

  • "Personal, non-commercial" means you are using the Services for yourself or your immediate family or household. Educational, classroom, organizational, or commercial use requires a separate written agreement with us (see contact information at the end of this document).

  • This license starts when you install the app or first access the Services and ends when these Terms end (see Section 11).

  • We may release new features, content packs, or improvements over time. They are governed by these Terms unless we explicitly say otherwise.

  • All rights not expressly granted to you in these Terms are reserved by Play With ASL.

7. Restrictions

You agree not to do any of the following:

  • Reverse engineer, decompile, disassemble, or otherwise try to discover the source code or underlying ideas of the Services, except where this restriction is prohibited by applicable law.

  • Copy, modify, translate, or create derivative works of the Services, the card pack content, the ASL vocabulary curriculum, the videos, the artwork, or any other materials we provide.

  • Remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the Services.

  • Sell, rent, lease, sublicense, distribute, or otherwise transfer access to the Services, your account, or your subscription.

  • Use any robot, scraper, or automated tool to access the Services, or interfere with, overload, or disrupt the Services or the servers and networks that run them.

  • Circumvent, disable, or otherwise interfere with the paywall, subscription gating, card pack entitlement system, or any other security or access-control measure.

  • Use the Services in any way that violates applicable law, infringes anyone else's rights, or is fraudulent, harassing, or harmful.

We may, but are not required to, monitor compliance and we may suspend or terminate accounts that violate these restrictions (see Section 11).

8. Intellectual Property

The Services — including the Play With ASL name, logos, app design, game mechanics, the curated ASL vocabulary curriculum, the ASL video content, the ASL text, graphics, images, and icons, the photographs and illustrations, the audio, the look and feel, and all related software — are owned by us or our licensors and are protected by copyright, trademark, and other intellectual-property laws.

  • Aside from the limited license in Section 6, these Terms do not grant you any right, title, or interest in the Services, in any of our content, or in any other intellectual property.

  • Trademarks, service marks, and trade names are the property of their respective owners. You may not use ours, including, without limitation, U.S. Trademark Reg. No. 7,415,831 for PLAY WITH ASL, without our prior written permission.

  • We respect the intellectual-property rights of others. If you believe content in the Services infringes your copyright, send a notice with the information required by 17 U.S.C. § 512(c)(3) to jon@playwithasl.com.

9. User Content

The current version of the Services does not allow you to post, upload, or share user-generated content with other users. There are no public profiles, no comments, no chat, and no shared leaderboards.

  • The only content you submit to us is account information (such as your email, name, and optional profile photo) and customer-support messages. Our use of that information is governed by the Privacy Policy.

  • If you send us feedback or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them to improve the Services, without any obligation to compensate or credit you.

  • We may add user-content features in the future (for example, the ability to upload a custom photo to a card or share progress with a teacher). If we do, we will update these Terms first, and additional rules will apply at that time. Illegal, infringing, or abusive content is prohibited. We reserve the right to moderate or remove any future user content, although we undertake no obligation to do so.

10. Privacy

Our Privacy Policy explains what information we collect, why we collect it, how we use it, and the choices you have. By using the Services, you agree to the practices described there.

In summary, and consistent with our App Store and Play Store privacy disclosures:

  • Data linked to you: email, name, phone (if you provide it), user ID, device ID, purchase history, and product interaction events used to improve the Services.

  • Diagnostics not linked to you: crash reports, performance data, and other diagnostic information.

  • No tracking. We do not use third-party advertising identifiers, we do not track you across other apps or websites, and we do not sell your personal information.

You can review your privacy choices or request data deletion at https://www.playwithasl.com/privacy-policy/delete-data, or by deleting your account from inside the app as described in Section 3.

11. Termination

Termination by you. You can stop using the Services at any time. To fully end the relationship, delete your account from inside the app (Section 3) and cancel any active subscription through the App Store or Google Play (Section 4).

Termination by us. We may suspend or terminate your access to the Services, in whole or in part, if you materially breach these Terms (including the restrictions in Section 7); if we are required to do so by law or a binding order from a court, regulator, app store, or payment processor; or if we discontinue the Services or a meaningful portion of them. When practical, we will give you notice and a reasonable chance to fix the issue before terminating.

Effect of termination. When these Terms end, your right to access the Services ends immediately. Sections that by their nature should survive — including Sections 6 (limits on your rights), 7, 8, 12, 13, 14, 15, 17, and 18 — will continue to apply. Termination does not, by itself, entitle you to a refund (see Section 4.4).

12. Disclaimers

Play With ASL is an educational entertainment app designed to help you build ASL vocabulary through games. We work hard to make the content accurate and helpful, but we cannot guarantee specific learning outcomes.

  • The Services are not certified ASL instruction, are not a substitute for a qualified ASL teacher or interpreter, and are not a substitute for any accessibility, medical, audiological, speech-language, or accommodation service. Do not rely on the Services for accessibility, safety-critical, medical, or legal decisions.

  • Sign language is a living language with regional variation. We try to represent widely used signs and to label regional or stylistic variations where we can, but variation between signers is normal and expected.

To the maximum extent permitted by applicable law, the Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. We disclaim all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any content (including any ASL representation) will be free of errors.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In that case, those warranties are limited to the minimum extent permitted by applicable law.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

  • We, our affiliates, and our directors, officers, employees, contractors, and licensors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, lost goodwill, or substitute service costs — arising out of or related to these Terms or your use of the Services, even if we have been advised of the possibility of those damages.

  • Our total cumulative liability to you for all claims arising out of or related to these Terms or the Services is limited to the greater of (a) the total amounts you actually paid us for the Services in the twelve (12) months before the event that gave rise to the claim, or (b) one hundred U.S. dollars (USD 100).

These limits apply regardless of the legal theory (contract, tort, statute, or otherwise) and regardless of whether the limited remedy fails of its essential purpose.

Consumer-rights carve-outs. Some jurisdictions do not allow the exclusion or limitation of certain damages — for example, damages for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or other liabilities that cannot be waived by law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including any non-waivable consumer rights you may have in your country, state, or province.

14. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Play With ASL, LLC and its affiliates, and their respective directors, officers, employees, contractors, and licensors, from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Services in violation of these Terms or applicable law;

  • Your breach of any representation or obligation in these Terms;

  • Your violation of any third party's rights, including intellectual-property or privacy rights; or

  • If you are a parent or guardian creating an account for a child, the child's use of the Services.

We will give you prompt notice of any claim we receive, let you control the defense and settlement of the claim (subject to our right to participate with our own counsel at our expense), and reasonably cooperate with you. You may not settle any claim in a way that imposes a non-monetary obligation on us, or admits fault on our behalf, without our written consent.

15. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to them or the Services are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15.1 Informal dispute resolution first

We want to work things out with you directly. Before filing a formal claim, you agree to first send a written notice to jon@playwithasl.com describing the dispute and the relief you are seeking, and to give us at least 60 days to try to resolve it informally. We will do the same before filing a claim against you. Most issues can be resolved at this stage.

15.2 Binding individual arbitration

If we cannot resolve the dispute informally, you and Play With ASL agree that any dispute arising out of or related to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, then in effect. The arbitration will be seated in Wilmington, Delaware, and may be conducted in person, by telephone, by video, or by submission of documents, at the arbitrator's discretion and consistent with the AAA's rules. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

The arbitrator — and not any federal, state, or local court or agency — has exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this Section 15.2, including any claim that all or any part of it is void or voidable.

15.3 Class-action waiver

You and Play With ASL agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If a court or arbitrator decides that this class-action waiver is unenforceable as to any particular claim or request for relief, then that claim or request for relief (and only that claim or request for relief) must be severed from the arbitration and may be brought in a court of competent jurisdiction in accordance with Section 15.4. The remaining claims will continue in arbitration.

15.4 Small-claims and injunctive relief

Nothing in this Section prevents either party from bringing an individual claim in a small-claims court with jurisdiction, or from seeking injunctive or equitable relief in court to protect intellectual-property rights or confidential information.

15.5 Time limit

Unless applicable law requires otherwise, any claim related to the Services must be brought within one (1) year after the cause of action arises, or it is permanently barred.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will:

  • Change the "Last Updated" date at the top of this document.

  • For material changes — for example, changes to subscription terms, dispute resolution, or your privacy choices — give you reasonable advance notice through the app, by email, or by both, before the changes take effect.

Your continued use of the Services after the new Terms take effect means you accept the updated Terms. If you do not agree, please stop using the Services, cancel your subscription through the App Store or Google Play, and delete your account.

We will not make a material change to your existing subscription's price or core entitlements without the advance notice required by the store and applicable law, and we will respect any right to refuse a price change that the store provides.

17. General

This Section gathers standard contract-administration provisions that apply to your entire agreement with us.

17.1 Entire agreement

These Terms, together with our Privacy Policy and any in-app paywall disclosures, store-mediated billing terms, and other notices we expressly reference, are the entire agreement between you and Play With ASL with respect to the Services, and supersede any prior or contemporaneous agreements, communications, or understandings on that subject. Apple's Standard EULA and Google Play's Terms of Service apply on their respective platforms as described in Section 1.

17.2 Severability

If any provision of these Terms is held to be unenforceable, invalid, or illegal by a court or arbitrator of competent jurisdiction, that provision will be enforced to the maximum extent permitted by applicable law, and the remaining provisions will remain in full force and effect. The unenforceable provision will be deemed modified only to the extent necessary to make it enforceable.

17.3 No waiver

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. Any waiver of these Terms must be in a writing signed by us to be effective.

17.4 Assignment

You may not assign or transfer these Terms, or any of your rights or obligations under them, without our prior written consent. Any attempted assignment in violation of this Section is void. We may assign or transfer these Terms, in whole or in part, at any time without restriction — including in connection with a merger, acquisition, corporate reorganization, financing transaction, or sale of all or substantially all of our assets. These Terms bind and benefit each party's permitted successors and assigns.

17.5 Force majeure

We are not liable for any delay in or failure of performance under these Terms that is caused by circumstances beyond our reasonable control, including acts of God, natural disasters, fire, flood, earthquake, war, terrorism, civil unrest, government action or order, labor disputes, epidemics or pandemics, internet or telecommunications outages, hosting or cloud-provider failures (including Amazon Web Services, Apple, Google, and our payment processors), or other events of force majeure. If such an event materially affects our performance, we will use commercially reasonable efforts to resume normal operations as soon as practicable.

17.6 Headings; construction

Section headings are for convenience only and do not affect the interpretation of these Terms. The words "including," "include," and "such as" are used without limitation.

17.7 Notices

Notices to you may be sent through the app, by email to the address associated with your account, or by any other method permitted by these Terms. Notices to us must be sent to the address listed in Section 18 or by email to jon@playwithasl.com.
